Oxygenshell offers an exceptional level of performance, reliability, and service. The Oxygenshell (SLA) guarantees our network and equipment performance. This applies to Oxygenshell web hosting, dedicated server, co-location, Unix account services.


SECTION 1. Uptime

We strive to keep an uptime of 99.9% network uptime. These figures are projected monthly. We however will not credit a full months of service at anytime for any reason. Partial refunds for downtime will be considered but are not guaranteed and will be issued in extreme circumstances.

SECTION 2. Credits

1. NO CREDIT

If its beyond our reasonable control including war, acts of god, fires, sabotage, interruption in service (fiber cut), tornado, earthquake, government investigations, delay in transit, peering issues, scheduled service updates, hardware failure, your own mistakes, software bugs, network attacks, hacks and other things/issues/miss-fortune that you/Oxygenshell finds uncontrolling. Credits will not be issued for neglect or not using your service or non-approvement of services rendered, or services ordered.

2. CREDIT

If there is more than 24 hour downtime, scheduled maintenance more than 1 hour within one day of time will be credited in a manner Oxygenshell and Client Agree on but cant exceed 1/5th of service equal to 6 days per month. please see REFUNDS
 

SECTION 3. Connections

Our goal is to make our network free of outages for 95%. An outage is defined as no signal transmission between Oxygenshell Sub Network and Reseller Affiliates for more than 15 minutes. Our goal is to utilize the best networking equipment to maintain 85 milliseconds within our network. Your Co-location, Dedicated Servers if applicable are periodically monitored for incoming and outgoing data transfer using software and hardware components. You acknowledge and allow Oxygenshell to do such monitoring.

SECTION 4. Refunds

A. Oxygenshell does not credit its clients refunds for services ordered. No setup fee or monthly fee will be credited for any reason.
B. Oxygenshell expects ALL users to obey the rules of the various IRC Networks, failure to do so can result in account termination without refund.
C. IRCNET - This network allows 2 users from user@ipblock, most IRCNET servers do not allow bots of any kind either, if you get klined on IRCNET or another user on our machines does, we will not do anything on your behalf to have it removed. We do not support IRCNET, you are on your own if you can connect there or not.
D. If your account or any other accounts are klined off networks, we will NOT issue a refund because you cant get on the IRC network, find another IRC network to use.

SECTION 5. Theft of Services

Oxygenshell reserves the right to charge an extra fee at the users expense for the price of said service but not to exceed $50.00 unless said service is exceeded.

SECTION 6. Random

Oxygenshell has the right to suspend or remove your account at any given time WITHOUT notice.

Oxygenshell reserves the right to modify this SLA to benefit clients. And may make modifications without prior notice. All modifications will be posted on this URL supplied by Oxygenshell. www.oxygenshell.com/sla.html.
